Basic information

Unless otherwise indicated in the following sections, we never collect, process or use personal data when you use our website.
If you access our Internet pages, our web servers automatically obtain information of a general kind. This includes the web browser type, the operating system used, the domain name of the Internet service provider, the IP address of the computer used, the website you are visiting us from, the pages you visit on our site, and the date and duration of the visit.
It is not possible for us to use this data to identify individual users. The information undergoes statistical analysis only, and is used exclusively to improve the appeal, the content and the functionality of our website.

The concept of personal data

The EU General Data Protection Regulation (GDPR) defines personal data as follows:
Any information relating to an identified or identifiable natural person ('data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Legal basis for the collection and processing of personal data:

The collection, processing and use of applicant data for the application process in our application portal HR4You is in the legitimate interest of Roto Frank Holding AG as described in point (f) of Article 6(1) of the GDPR. This interest is not overridden by the interests or fundamental rights and freedoms of the applicant.
Erasure of data and storage period:
Unless you have given your explicit consent to store your personal applicant data in our applicant pool as part of the application process, the data is retained for evidence purposes for six months after the end of the application, after which it is erased. Other storage periods only apply only other archiving rules apply under tax laws or other laws. In this case, the relevant data is not erased until the end of the statutory period.

Collecting and processing personal data

So that we can process your application, we need to collect certain personal information. Beyond the extent which is legally required or permitted, any personal information we collect will only be used for the purpose of processing your application. Any further use of your data will only take place if we have obtained your explicit consent in advance. You can withdraw consent for future use from Roto Frank Holding AG at any time.
We ask you for certain information in our application portal. Mandatory information is marked as such and is only requested if it is absolutely necessary in order to assess an applicant's suitability for a vacant position.
The purpose of the optional field "How did you find us?" is to determine which job portals most of our applications come from so we can decide where to place ads in future.
The data you enter is not sent to our servers until you click the "Save/Send" button. Before then, you can make changes to the information you have entered.

Data transfer to affiliated companies

Your data will not be transferred to third parties outside the Roto Group unless we are legally required to do so or the transfer is necessary in order to complete the contract between us or you have given your explicit consent to the transfer in advance.

Data transfer to external service providers (processors)

You data will only be transferred to service partners if they are acting on our behalf and they support the Roto Group in the provision of its services.
Processing of your personal data by engaged service providers is governed by Article 28 of the GDPR.
Such service providers only have access to the personal information they need in order to perform the tasks in question. The service providers are not allowed to pass on your personal information or use it for any other purpose, in particular for their own marketing purposes.
Where external service providers are able to access your personal data, we ensure through legal, technical and organisational measures and through regular inspections that they too comply with the applicable data protection rules.
Your personal data will not be passed to other companies for commercial purposes.

Website optimisation tools

When we collect personal data via website optimisation tools, we do so on the basis of our legitimate interest as stated in point (f) of Article 6(1) of the GDPR and Recital 47. Under these provisions, direct marketing generally constitutes a legitimate interest. Your interests or fundamental rights and freedoms do not override our marketing interest because our data protection statement contains extensive information about data collection and because you can opt out at any time (via a link or browser settings). In addition, we only use pseudonymous tracking.

Cookies

Some parts of our website use cookies. A cookie is a small text file that is stored on your hard disk by a website. Cookies do not damage your computer and do not contain viruses. Cookies from our website do not collect any personal data. We use the information contained in cookies to make it easier for you to use our web pages and to adapt them to meet your needs.
Our website uses session cookies as well as persistent cookies. Session cookies are temporary cookies that are stored in the user's browser until the browser window is closed, deleting the session cookies. Persistent cookies are used for repeated visits and are stored in the user's browser for a particular period (normally a year or longer). These cookies are not deleted when the browser is closed. This cookie type is used to remember users' preferences when they come back to the website.

Piwik

This website uses Piwik, which is open source software for the statistical analysis of online visits. Piwik uses cookies, which are text files stored on your computer allowing your use of the website to be analysed. Information about your use of this Internet offering is generated by the cookie and stored on the service provider's server in Germany. Immediately after processing and before it is stored, the IP address is anonymised. You can change the settings in your browser software to prevent cookies being installed, but please note that you may not be able to use all the functions of the website in full.

Data security

Roto Frank AG implements technical and organisational security measures to protect the data under our control from accidental or intentional tampering, loss or damage, or from access by unauthorised third parties. Our security measures will be continuously improved in line with technological advances.

Rights of data subjects

If personal data concerning you is processed, you are a data subject as defined in the GDPR, which gives you the following rights in respect of the controller: 
Right of access (Article 15 of the GDPR)
You can obtain from us confirmation as to whether or not personal data concerning you is being processed by us. If we process data concerning you, you have additional rights of access as set out in Article 15 of the GDPR.

  • Right to rectification

If the data we collected from you is inaccurate or incomplete, you can ask us to rectify the data without delay as set out in Article 16 of the GDPR.

  • Right to restriction of processing

Under the conditions listed in Article 18 of the GDPR, you can instruct us to restrict the processing of personal data concerning you.
After such restriction, your personal data will only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State. We will inform you before the restriction of processing is lifted.

  • Right to erasure

On any of the grounds listed in Article 17(1) of the GDPR, you may instruct us to erase the personal data concerning you unless one of the exceptions listed in Article 17(3) of the GDPR is applicable.

  • Right to information

If you have exercised your right to rectification, erasure or restriction of processing, we are under an obligation under Article 19 of the GDPR to notify all recipients of your personal data unless this proves impossible or involves disproportionate effort. You are also entitled to be informed about the recipients. You are entitled to instruct the controller to inform you about those recipients.

  • Right to data portability

You also have the right under Article 20 of the GDPR to receive the personal data concerning you in machine-readable format and to transmit the data to another controller without hindrance under the conditions set out in point (a) of Article 20(1) of the GDPR, or to have your personal data transmitted directly from us to another controller, where technically feasible and where the rights and freedoms of others are not adversely affected. That right does not apply to processing of personal data which is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

  • Right to object

You have the right to object at any time to processing of personal data concerning you which is based on point (f) of Article 6(1).
We will no longer process your personal data unless there are legitimate grounds for the processing which override your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims.

  • Right to withdraw the declaration of consent under data protection law

You have the right to withdraw your declaration of consent at any time under data protection law by submitting a new declaration to Roto Frank Holding AG. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

  • Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right o lodge a complaint with a supervisory authority at any time, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes this Regulation.

This data protection statement will be continuously adapted as the Internet and our offering evolve. Any changes will be announced on this page in advance. You should return to this page regularly to keep up to date with our provisions concerning data use.
